Settlement Agent

A settlement agent (or closing agent) is the person or agency responsible for execution of the final steps in the sale, purchase or refinancing of a property. Along with preparing the settlement statement (usually referred to as the HUD-1) and overseeing the transfer of the legal title from the seller to the purchaser.

Some of the responsibilities of the settlement agent are to:

• search land titles and check for any liens.
• arrange for the discharge of liens.
• research local city/county and governmental departments about assessments and taxes so that payment for the current year are shared between the purchaser and seller, and that appropriate authorities are notified of the change in ownership.
• prepare the legal documents for settlement.
• ensure special conditions and contingencies relating to the purchase contract have been met
• arrange payment of recording taxes and other fees
• attend settlement on behalf of the client when necessary to oversee the exchange of documents and payment of funds
